Two-lot body corporate (duplex schemes)
Community titles schemes in Queensland can range from duplexes, residential unit blocks and high rise accommodation buildings to shopping complexes or business parks. They each have a body corporate and detailed processes to manage how they operate.
As of 2014, Queensland had more than 14,000 duplexes. These are community titles schemes with only 2 lots.
Reforms
Between 2008 and 2011, as part of a review of existing laws, we:
Identified a need to create simpler arrangements for owners to manage a duplex
Addressed this need by drafting new regulations.
Under the regulation, owners:
Can make a decision of the body corporate by written agreement between themselves
Don't need a body corporate committee and don't need to hold general meetings
Can authorise another person to act on their behalf in body corporate matters
Don't need to have administrative and sinking funds for the body corporate
Can agree between themselves how to fund the body corporate expenses may themselves—not the body corporate—issue a notice for a breach of the scheme's by-laws.
